Terms of service

These terms cover the NAURO Marine app for iOS and this website. They are an agreement between you and NAURO Marine (“we”). By using either, you accept them. The privacy policy explains how we handle your data.

1. A beta

NAURO Marine is in beta and is distributed through Apple TestFlight. It is free during the beta. Features may change, break or be removed without notice, TestFlight builds expire, and we may end the beta at any time.

Keep your own copy of anything important. Settings › Data exports the whole record.

There are no payments in the app today. If we introduce paid plans, we will tell you the price and terms before anything is charged.

2. Who can use it

You must be old enough to enter a binding contract where you live, or use NAURO Marine with a parent or guardian’s permission. It is not for children under 13. If you use it for a company or other organisation, you confirm you can accept these terms on its behalf.

3. Your account

You sign in with your email address and a one-time code. Anyone who can read that inbox can sign in, so keep it secure. You are responsible for activity under your account and for the people you invite as crew. Crew can see a boat’s record and, depending on their role, change it.

4. Acceptable use

Do not:

• break the law, or use NAURO Marine to harm anyone,
• upload content you do not have the right to share,
• try to reach another person’s account or boat,
• probe, overload, scrape or reverse engineer the service, except where the law allows it,
• get around HELM’s limits, or resell access to it.

5. Your content

The boat’s record, photos, papers and questions you put in stay yours. You give us permission to store, copy, process and display them, and to send them to the providers named in the privacy policy, only as needed to run NAURO Marine for you and your crew. That permission ends when you delete the content or your account, except as the privacy policy describes.

You confirm you have the right to upload what you add.

6. HELM and estimates

HELM answers from the boat’s own record, and it can be wrong or incomplete. Health scores, reminders, weather, tides, alerts and market value estimates are for information only. A value estimate is not an appraisal.

None of it is professional marine survey, mechanical, legal, insurance, tax or financial advice. Check anything that matters with a qualified person, the manufacturer’s manual or the official source before you rely on it. Do not rely on NAURO Marine for navigation or safety decisions underway.

HELM changes the record only when you confirm a change, and you are responsible for what you confirm.

7. Other services

NAURO Marine relies on services run by others, including Apple, Anthropic, Convex and public weather and tide sources. Their terms may also apply. We do not control them and are not responsible for their availability or accuracy. Weather data is from Open-Meteo.com, under CC BY 4.0.

8. Apple

Your use of the app is also governed by Apple’s Licensed Application End User License Agreement, and during the beta by Apple’s TestFlight terms. In addition:

• These terms are between you and us, not Apple. We, not Apple, are responsible for the app and its content.
• You may use the app on Apple devices you own or control, as Apple’s Usage Rules allow.
• Apple has no obligation to provide maintenance or support.
• If the app fails a warranty that applies, you may tell Apple, and Apple may refund any price you paid for it. To the extent the law allows, Apple has no other warranty obligation.
• We, not Apple, handle claims about the app, including product liability, legal or regulatory compliance, consumer protection and intellectual property claims.
• You confirm you are not in a country under a US government embargo and are not on a US list of prohibited or restricted parties.
• Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.

9. Feedback

If you send ideas or bug reports, through this site, TestFlight or email, we may use them to improve NAURO Marine without paying or crediting you. This gives us no rights to your boat’s record.

10. What is ours

The app, this website, and the NAURO name and mark belong to us. These terms give you the right to use NAURO Marine as described here and nothing more.

11. Ending

You can stop at any time, and delete your account in the app under More, your account, Delete account. We may suspend or close an account that breaks these terms or puts others at risk. Where we reasonably can, we will give notice and time to export your data.

Sections 5 to 15 continue to apply after your use ends, to the extent they are relevant.

12. Disclaimers

NAURO Marine is a beta, provided “as is” and “as available”. To the extent the law allows, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, accuracy and non-infringement. We do not promise that it will be uninterrupted, error-free or that data will never be lost.

13. Limitation of liability

To the extent the law allows, we are not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, data or use. Our total liability for any claim about NAURO Marine is limited to the greater of what you paid us in the 12 months before the claim, and 50 US dollars.

Some places do not allow these limits, so they may not apply to you. Nothing in these terms limits liability that the law does not allow to be limited.

14. Governing law

These terms are governed by the laws of the place where we are established, without regard to conflict-of-law rules. If you use NAURO Marine as a consumer, you keep the protection of the mandatory laws of the country you live in. Before bringing a claim, email us, since most problems can be settled that way.

15. Changes and the rest

We may update these terms. We will change the effective date above and, for a change that matters, tell you in the app or by email before it takes effect. If you keep using NAURO Marine after that, the new terms apply. If you do not agree, stop using it and delete your account.

If part of these terms cannot be enforced, the rest still applies. Not enforcing a term is not a waiver of it. These terms and the privacy policy are the whole agreement between you and us about NAURO Marine.
